TERMS AND CONDITIONS

Applicability

These general terms and conditions apply to all offers, orders and agreements of La-X-Mi Pure Power Pure Goddess.
Accepting an offer or placing an order means that you accept the applicability of these conditions.
The provisions in these conditions can only be deviated in writing, in which case the other provisions remain in full force.
All rights and claims, as stipulated in these conditions and in any further agreements for the benefit of La-X-Mi Pure Power Pure Goddess, are equally stipulated for the benefit of La-X-Mi Pure Power Pure Goddess intermediates and other third parties.

All offers of La-X-Mi Pure Power Pure Goddess are without obligation and La-X-Mi Pure Power Pure Goddess explicitly reserves the right to change prices, especially when this is necessary under (legal) regulations.
An agreement is only concluded after acceptance of your order by La-X-Mi Pure Power Pure Goddess.
La-X-Mi Pure Power Pure Goddess is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, La-X-Mi Pure Power Pure Goddess will notify this within five (5) working days after receipt of the order.

The prices of the products and services are offered in Euro, including VAT and excluding handling and shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing.
Payments can be made by payment in advance, via iDEAL online banking and a credit card from VISA, Mastercard or American Express.

The delivery times stated by La-X-Mi Pure Power Pure Goddess; for items in stock, a delivery time of 3 to 5 working days applies. For items that are not in stock, La-X-Mi Pure Power Pure Goddess will notify you in time and will offer you to terminate the agreement or to settle a new delivery time with La-X-Mi Pure Power Pure Goddess.
If the agreement is dissolved, the already paid amounts will be refunded within 14 days.
The delivery of the products takes place at the place and time when the products are ready for shipment to you.

The ownership of the delivered products will only transfer if you have paid the full amount that you owe to La-X-Mi Pure Power Pure Goddess under any agreement. The risk with regard to the products already transfers to you at the time of delivery.

You must fully and unconditionally respect all intellectual and industrial property rights that rest on the products supplied by La-X-Mi Pure Power Pure Goddess.
La-X-Mi Pure Power Pure Goddess does not guarantee that the products delivered to you do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.

You have the obligation to check on delivery whether the products meet the agreement. If this is not the case, you must send La-X-Mi Pure Power Pure Goddess as soon as possible and in any case within fourteen (14) days (including weekend) after the delivery, at least after detection was reasonably possible, in writing / email to give notice.
If it has been demonstrated that the products do not meet the agreement, La-X-Mi Pure Power Pure Goddess has the choice to replace the relevant products against new ones, if in stock, upon return.
If you do not wish to purchase a product for any reason, you as a private individual have the right to return the product to La-X-Mi Pure Power Pure Goddess within fourteen (14) days (including weekend) after delivery. The following conditions apply: the article must not have been used and must be returned undamaged and complete in the original packaging. The costs for returns are for your account.

La-X-Mi Pure Power Pure Goddess guarantees that the products to be delivered meet the usual requirements and standards that can be imposed on them and are free from any defects.
If the goods to be delivered do not meet the warranty, La-X-Mi Pure Power Pure Goddess will send the goods within a reasonable term after receipt or, if return is not reasonably possible, written notification of the defect by the buyer, to choice of La-X-Mi Pure Power Pure Goddess, replace or take care of recovery.
The warranty mentioned in this case does not apply if the defect arose as a result of improper or improper use or if, without written permission from La-X-Mi Pure Power Pure Goddess, the buyer or third parties have made changes or attempted to make changes to the product or used these for purposes for which this product is not intended.
In addition to these warranty provisions, statutory warranty provisions remain in force.

Without prejudice to the other rights vested in it, La-X-Mi Pure Power Pure Goddess has the right, in the event of force majeure, to suspend the execution of your order, or to dissolve the agreement without judicial intervention, at its own discretion, by informing you in writing and this without La-X-Mi Pure Power Pure Goddess being obliged to pay any compensation, unless this would be unacceptable in the circumstances given the standards of reasonableness and fairness.
Force majeure means any shortcoming that cannot be attributed to La-X-Mi Pure Power Pure Goddess, because it is not due to its fault and is not for its account under the law, legal act or prevailing views.

If you provide La-X-Mi Pure Power Pure Goddess in writing with an address, La-X-Mi Pure Power Pure Goddess is entitled to send all orders to that address, unless you inform La-X-Mi Pure Power Pure Goddess, provided in writing, a different address to which your orders must be send.
If one or more of the provisions of these conditions or any other agreement with La-X-Mi Pure Power Pure Goddess conflict with any applicable legal provision, the provision in question will expire and will be replaced by a La-X-Mi Pure Power Pure Goddess newly adopted, new legally permissible comparable provision.
La-X-Mi Pure Power Pure Goddess is authorized to use third parties for the execution of your order (s).

All rights, obligations, offers, orders and agreements to which these conditions apply, as well as these conditions, are exclusively governed by Dutch law.
All disputes between parties will be submitted exclusively to the competent court in The Netherlands.
